우한 폐렴 발생 사실을 두 달 동안 은폐하여 각국이 대비할 시간도 없이 전세계적으로 창궐하게 만든 주범인 중국을 상대로 집단 소송이 시작되었다. 중국이 비난받는 이유는 우한 바이러스의 발원지라서이기 보다는 초기에 바이러스 감염 발생을 숨겨 조기 진압할 기회를 놓쳤고, 사람간의 전파는 일어나지 않는다는 허위 정보를 흘린 것, 중국내에서 확진자 수와 사망자 수를 조작하여 정확한 감염의 진행 과정을 알 수 없게 한 것, 세계 각국에서 마스크, 방호복 등을 대규모로 매집하여 바이러스가 다른 국가들에까지 확산되었을 때는 의료물자 부족으로 사태가 더 악화되도록 한 것 등을 들 수 있다.

한국의 우한 폐렴 피해자들도 중국을 상대로 집단 소송을 시작하고, 국내 중국 자산에 대한 가압류부터 시작하는 것이 좋을 것이다.

이런 일을 다시 겪지 않으려면 세계적으로 인류를 위협하는 중국 공산당 해체 운동에 들어갈 필요가 있다.

중국 상대 소송을 위한 미국의 입법 움직임

미국 공화당(GOP)의 하원의원 Dan Crenshaw (텍사스 주)와 상원의원 Tom Cotton(아컨사스 주)은 미국인 코로나 피해자들이 중국 정부를 상대로 미국 법정에 소송을 제기할 수 있도록 입법을 하겠다고 나섰다.

Two Republican lawmakers in the House and Senate, respectively, have introduced legislation that would allow Americans to sue the Chinese government for damages caused by the coronavirus pandemic -- which U.S. officials have blamed on the Chinese.

The bill, introduced by Rep. Dan Crenshaw, R-Texas, in the House and Sen. Tom Cotton, R-Ark., in the Senate, would allow Americans to sue the communist country in federal court by amending the Foreign Sovereign Immunities Act.

“By silencing doctors and journalists who tried to warn the world about the coronavirus, the Chinese Communist Party allowed the virus to spread quickly around the globe. Their decision to cover up the virus led to thousands of needless deaths and untold economic harm. It’s only appropriate that we hold the Chinese government accountable for the damage it has caused,” Cotton said in a statement.

The legislation is modeled after the Justice Against Sponsors of Terrorism Act, and seeks “to provide a civil action against a foreign state for deliberate concealment or distortion of information with respect to an international public health emergency.”

“There’s an increasing amount of evidence that shows they are culpable,” Crenshaw said on “Fox & Friends" on Saturday. “So what can we do about that? Well, when Americans are wronged. We sue somebody -- so let’s let Americans sue the Chinese Government.”

If that turns out to be true.”
Cotton also demanded “consequences” for the Chinese Communist Party “if it turns out that Chinese negligence and then Chinese corruption and treachery was responsible for unleashing this pandemic on the world.”

각국에서 중국을 상대로 소송을 벌일 기세이고, 중국이 배상에 응하지 않더라도 해당 국가에 있는 중국 자산이 몰수될 수 있다. 이 중에 가장 치명적인 것은 미국의 소송이다. 미국에서는 이미 중국 상대의 천문학적인 배상 소송이 제기되어 있고, 만약에 승소한다면 중국이 보유하고 있는 미국 국채는 무용지물이 될 수 있다. 중국이 가지고 있는 미국에 대한 채권이 압류 당할 수 있을 것이다.

인도의 경우

Global lawsuits against China for “patent breaches” of the International Health Regulations over its handling of COVID-19 could run to at least £3.2 trillion from just the nations of the G7, according to a newly released report.

The report claims that the Chinese government’s early handling of the disease and failure to adequately report information to the WHO breached Articles Six and Seven of the International Health Regulations [IHRs], a Treaty to which China is a signatory and legally obliged to uphold. These breaches allowed the outbreak to rapidly spread outside Wuhan, its place of origin.

In particular, our research has discovered that the Chinese government:

  • Failed to disclose data that would have revealed evidence of human-to-human transmission for a period of up to three weeks from being aware of it, in breach of Articles six and seven of the IHRs.
  • Provided the WHO with erroneous information about the number of infections between 2 January 2020 and 11 January 2020, in breach of Articles Six and Seven of the IHRs.
  • Failed to proscribe avoidable vectors of lethal zoonotic (animal-originated) viral infection, instead actively promoting the massive proliferation of dangerous viral host species for human consumption in breach of Article 12 of the International Covenant on Economic, Social, and Cultural Rights.
  • Allowed 5 million people (roughly equivalent to the size of The San Francisco Metropolitan Area, CA or Greater Boston, MA in the USA, and roughly five times the size of a city the size of Birmingham, UK) to leave Wuhan before imposing the lockdown on 23 January 2020 despite knowledge of human-to-human transmission.
